VIRGINIA

The U.S. Department of Justice announced on October 6 that David J. Rush, 49, of Ashburn, Virginia, a former high-ranking official at a federal agency, pleaded guilty to a scheme in which he created a fabricated Special Access Program (SAP) to obtain $193,590,400 in federal funds. On May 19, the FBI seized 298 gold bars from Rush's residence. The Justice Department stated the loss to the federal government from the scheme was approximately $194 million. Rush has pleaded guilty but has not yet been sentenced, with sentencing scheduled for January 28, 2027\. Court documents describe how Rush obtained the funds.

## Rush fabricated non-existent government authorizations, including a fraudulent Special Access Program, to obtain funds

According to court documents, Rush held a senior executive-level position at a federal agency and maintained a TS/SCI (Top Secret/Sensitive Compartmented Information) security clearance. Court documents stated that Rush falsified his educational background and military record, which played a role in his appointment to the position. The Justice Department explained that Rush used his position of significant public trust to create fictitious government authorizations, including a fabricated Special Access Program (SAP), and used those authorizations to receive U.S. government funds for his personal benefit.

The term Special Access Program refers to a U.S. government classification and protection term. U.S. government glossaries define a Special Access Program as a program imposing safeguarding and access requirements that exceed those normally required for information at the same classification level. The SCI attached to Rush's security clearance refers to classified information concerning intelligence sources and methods handled within formal access control systems. The Justice Department explained that Rush obtained the funds by fabricating the existence of such a program.

The flow of the funds after receipt was also detailed in the Justice Department's announcement. After receiving the funds, Rush purchased gold bars and directed wire transfers of approximately $145 million. The Justice Department stated that these wire transfers were ultimately used to purchase luxury real estate, luxury watches, and at least one vehicle. In the subtitle of its release, the Justice Department noted that the scheme included the fraudulent acquisition of tens of millions of dollars in gold bars and luxury properties in Florida.

Assistant Attorney General for National Security John A. Eisenberg said that the Intelligence Community must have the trust of the American people to operate effectively. "Rush repeatedly betrayed that trust," Eisenberg said. He explained that Rush defrauded the United States of approximately $194 million in 298 gold bars, real estate, jewelry, and other valuable assets. Where some of those assets were located was revealed during the FBI's May 19 search.

## FBI seized 298 gold bars and cash from Rush's home on May 19

On May 19, the FBI searched Rush's residence, seizing 298 gold bars, approximately $2,106,550 in U.S. currency, 104,795 euros, and multiple luxury watches. The Justice Department stated that the cost to the federal government to acquire these gold bars was approximately $46 million. This figure reflects the cost incurred by the government rather than the market value of the gold. The items recovered from the residence represent a portion of the defrauded funds, with the remainder having been converted into other assets such as real estate, watches, and vehicles.

In pleading guilty, Rush also agreed to forfeiture. According to the Justice Department, under the agreement Rush agreed to forfeit the gold bars and cash seized from his home, the fraudulently acquired real estate, 30 watches, and two 2026 BMW Alpinas. Many of the watches are Rolexes. At least one of the Alpinas is valued at approximately $172,000, according to the Justice Department.

In addition to the FBI, the Naval Criminal Investigative Service (NCIS) participated in the investigation. The Justice Department noted that NCIS provided valuable assistance in the investigation. The Justice Department's Counterintelligence and Export Control Section and the U.S. Attorney's Office for the Eastern District of Virginia are jointly handling the case. Justice Department guidelines provide that criminal prosecutions related to national security are placed under the supervision of the Assistant Attorney General for National Security, with the Counterintelligence and Export Control Section conducting and supervising them. Approximately four and a half months elapsed between the search and the announcement of the guilty plea, with court sentencing and two parallel further inquiries remaining ahead.

## Sentencing is set for January 28, 2027, with a maximum penalty of 20 years in prison

The maximum statutory penalty Rush faces is 20 years in prison. The Justice Department stated that the maximum penalty also includes three years of supervised release, forfeiture, restitution, and a fine. The sentence will be determined by a federal district court judge after taking into account the U.S. Sentencing Guidelines and other statutory factors. The case is currently at the guilty plea stage, and no sentence has yet been imposed. The case is proceeding in the U.S. District Court for the Eastern District of Virginia under case number 1:26-cr-00185.

The investigation is also not concluded. The Justice Department stated that the investigation remains ongoing. The Justice Department noted that the Director of National Intelligence requested that the Inspector General of the Intelligence Community initiate a separate inquiry. The Justice Department's investigation and the Inspector General's inquiry are distinct proceedings. The Office of the Inspector General of the Intelligence Community was established within the Office of the Director of National Intelligence pursuant to the Intelligence Authorization Act for Fiscal Year 2010 (Public Law 111-259). Under Title 50, Section 3033 of the United States Code, the purpose of the office is to initiate and conduct independent investigations, inspections, audits, and reviews of programs and activities within the responsibility and authority of the Director of National Intelligence. The Inspector General reports directly under the general supervision of the Director of National Intelligence, and must report expeditiously to the Attorney General upon receiving information or allegations relating to violations of federal criminal law in intelligence community programs or interagency relationships. The scope of the Inspector General's inquiry and when its findings will be issued have not been announced.

> “Our Intelligence Community must have the trust of the American people to operate effectively in a Nation committed to transparency and the rule of law,” said Assistant Attorney General John A. Eisenberg. “Rush repeatedly betrayed that trust. He defrauded the United States out of… [https://t.co/hZ53NErJZE](https://t.co/hZ53NErJZE?ref=bexus.info)

The prosecution is being handled by Trial Attorneys Kevin C. Hakala and Kathryn D. DeMarco of the Justice Department's Counterintelligence and Export Control Section, and Assistant U.S. Attorneys Liza K. Tee, Gavin R. Tisdale, and Anthony T. Aminoff of the U.S. Attorney's Office for the Eastern District of Virginia. Different baselines apply to the respective monetary amounts.

## Amounts cited by the Justice Department break down into losses, fraud totals, wire transfers, and gold costs

Approximately $194 million is the loss figure cited by the Justice Department, while $193,590,400 represents the federal funds fraudulently obtained by Rush. The two numbers represent the same sum, rounded differently. Approximately $145 million is the money Rush directed to be wire transferred, which went toward purchasing real estate, watches, and vehicles. The 298 gold bars cost the federal government approximately $46 million to acquire. All figures are based on the Justice Department's October 6 announcement.

The seized cash totaled approximately $2,106,550 and 104,795 euros as of the May 19 search. This cash and the gold bars are subject to the forfeiture agreement. While the Justice Department included the fraudulently obtained real estate among the forfeiture assets, it did not disclose the number or value of the properties. The mention of Florida in the subtitle is all the real-estate-related information made public by the Justice Department.

What Rush admitted to was carrying out the fraudulent scheme. The prison sentence, the scope of forfeiture, and the amounts of restitution and fines will be determined at sentencing. Statements from agency heads were also included in the Justice Department announcement.

## CIA Director Ratcliffe says CIA immediately referred matter to FBI after internal inquiry identified potential crimes

The Justice Department described Rush's employer only as a federal agency and did not disclose the agency's name. CIA Director John Ratcliffe stated in a quote included in the Justice Department release: "Following an internal inquiry that identified potential criminal wrongdoing, CIA immediately referred the matter to the FBI." Director Ratcliffe said Rush abused his position, betrayed the public trust, and must be held fully accountable for his actions. He expressed gratitude to the FBI and the Justice Department for bringing about the result. He added that the CIA will hold those entrusted with the nation's secrets to the highest standards.

FBI Director Kash Patel said, "As he admitted, Rush defrauded the government of hundreds of millions of dollars, using the proceeds to make lavish purchases." Director Patel stated that Rush betrayed his oath, his colleagues, and the American people. He added that the guilty plea demonstrates the FBI's stance that no government position, security clearance, or access to government resources places anyone above the law. Attorney General Todd Blanche said, "Federal employees are entrusted with serving the American people, not themselves."

Assistant Attorney General Eisenberg stated that Rush's actions threatened to erode public confidence in the intelligence agencies that work covertly to keep America safe. He said the efforts of the Justice Department, law enforcement partners, and the Intelligence Community uncovered Rush's crimes, calling the guilty plea a significant step toward holding Rush accountable before the law. First Assistant U.S. Attorney Theofani K. Stamos for the Eastern District of Virginia said Rush took not only the nation's money, but also its faith. First Assistant U.S. Attorney Stamos stated that the office will continue to prosecute those who undermine the security of the United States.
