ATLANTA, United States

A 31-year-old man accused of throwing a Molotov cocktail at an Atlanta ICE building has been arrested by the Federal Bureau of Investigation (FBI). The facility is an Immigration and Customs Enforcement (ICE) building located in downtown Atlanta, Georgia. The U.S. Department of Justice's U.S. Attorney’s Office for the Northern District of Georgia announced on October 23 (local time) that Inique Hinton of Douglasville, Georgia, was arrested that day on federal criminal charges for allegedly throwing a Molotov cocktail at the Atlanta ICE building earlier this week.

According to prosecutors, a federal magistrate judge issued a criminal complaint against Hinton that day charging him with attempted arson of a federal building and depredation of government property. Hinton was arrested several hours later at a residence in Cobb County.

Prosecutors: "Suspect Seen on Security Cameras"... Scorched Cloth, Lighter Fluid, Glass Bottle Recovered from Scene

According to U.S. Attorney for the Northern District of Georgia Theodore S. Hertzberg and allegations set forth in court filings, security cameras captured Hinton walking near the ICE facility at 180 Ted Turner Drive in downtown Atlanta at approximately 8:12 p.m. on October 20. Minutes later, Hinton ignited an object and threw it toward the ICE building. The object struck the facility's perimeter fence and caught fire. Investigators subsequently recovered scorched cloth, lighter fluid, a glass bottle, and a lighter from the scene.

The U.S. Department of Homeland Security (DHS) said in a statement on October 22 that "on the evening of October 20, a male suspect threw an improvised incendiary device toward the ICE Enforcement and Removal Operations (ERO) Atlanta Field Office," adding that "miraculously, the device did not impact the facility and was caught on the top of the perimeter fence." According to DHS, an Atlanta police officer in the immediate vicinity witnessed the incident and pursued the suspect, but the suspect fled the scene. DHS released photographs of the incendiary device used in the crime and the perimeter fence where it was caught alongside the statement.

On October 21, the day after the incident, the FBI Atlanta Field Office announced a reward of up to $20,000 for information leading to the suspect's arrest. In the notice, the FBI stated that the suspect fled southbound along Ted Turner Drive after the crime. The FBI urged anyone with information regarding the suspect’s identity or whereabouts, or information helpful to the investigation, to contact Atlanta Crime Stoppers (404-577-TIPS), the FBI tip line (1-800-CALL-FBI), or submit tips online at tips.fbi.gov. The FBI also posted a separate seeking-information poster on its website for the male suspect, who was unidentified at the time of the incident.

The U.S. Attorney’s Office for the Northern District of Georgia posted on its official X account on October 23: "Inique Hinton, a Douglasville, Georgia resident, was arrested today on federal charges after he allegedly threw a Molotov cocktail at the Atlanta Immigration and Customs Enforcement (ICE) building earlier this week."

U.S. Attorney: "Arson Targeting Government Facilities Will Be Relentlessly Investigated and Prosecuted"

"Attacking a federal facility with an incendiary device like a Molotov cocktail is a cowardly act of terror that demands an immediate, severe response," Hertzberg said. "Our office will relentlessly investigate, hunt down, and prosecute any act of arson directed at government facilities, ensuring that those responsible face the full weight of their actions."

"Those who target government buildings with fire and violence will be held accountable," said Marlo Graham, Special Agent in Charge of the FBI Atlanta Field Office. "The FBI, along with our law enforcement partners, will protect our communities while respecting the First Amendment rights of all individuals."

The FBI Atlanta Field Office posted on its official X account on October 23: "Arrested! FBI Atlanta this afternoon arrested Inique Hinton, from Douglasville, on federal charges after he allegedly threw a Molotov cocktail at the Atlanta Immigration and Customs Enforcement (ICE) building earlier this week." A video showing the arrest was included in the post.

The case is being investigated by the FBI with assistance from the Atlanta Police Department, and Assistant U.S. Attorney Dashene Cooper is prosecuting the case. The prosecution stated that "the criminal complaint contains only allegations, and the defendant is presumed innocent, and the burden is on the government to prove the defendant's guilt beyond a reasonable doubt at trial."

HSI: "Extraordinary Collaboration Led to Swift Arrest"

U.S. Immigration and Customs Enforcement announced in an October 25 press release that federal law enforcement authorities arrested Hinton in connection with an attempted Molotov cocktail attack on the Atlanta ICE office, and that he has been federally charged with arson and depredation of federal property. According to ICE, the investigation and arrest were carried out through the collaboration of the Joint Terrorism Task Force (JTTF), the FBI, DHS, ICE, and the U.S. Attorney’s Office for the Northern District of Georgia, and the investigation remains ongoing. ICE noted that additional information regarding the charges and court proceedings is handled by the U.S. Attorney’s Office for the Northern District of Georgia. According to the ICE press release, Hinton's full name is Inique Shaquil Hinton.

"An operation of this speed and scale requires extraordinary collaboration," said Ellen Johnson, acting Special Agent in Charge for Homeland Security Investigations (HSI) Georgia and Alabama. "I want to extend my sincere gratitude to our law enforcement partners for their exceptional work on this case, including the tireless dedication of our Joint Terrorism Task Force colleagues, the FBI, DHS, and the U.S. Attorney’s Office for the Northern District of Georgia."

Secretary of Homeland Security: "Assaults on ICE Officers Up Over 1,600%... Will Not Be Tolerated"

Secretary of Homeland Security Markwayne Mullin said in a statement on October 22, "This attack is just the latest example of the dangerous and unacceptable escalation of violence directed at ICE officers who are simply enforcing the laws of the United States." Secretary Mullin added, "Irresponsible rhetoric from sanctuary city politicians and radical activists has contributed to a massive increase in violence and threats against federal law enforcement officers carrying out their congressionally mandated mission. ICE officers are facing a more than 1,600% increase in assaults." He continued, "Attacks on our personnel and facilities will not be tolerated. Anyone who targets federal law enforcement will be prosecuted to the fullest extent of the law."

DHS stated, "This incident follows an escalating pattern of violence directed at ICE facilities and personnel nationwide. The brave men and women of ICE put their lives on the line every day to apprehend criminal illegal aliens, including murderers, rapists, gang members, and terrorists, and to make our communities safer."

National Security Presidential Memorandum 7 and Joint Task Force Vanguard

According to prosecutors, this case is being handled as part of the nationwide National Security Presidential Memorandum 7 (NSPM-7) initiative. This initiative is a whole-of-government effort directed by the White House that integrates federal, state, and local agencies to target individuals and organizations engaged in political violence while protecting First Amendment rights. Joint Task Force Vanguard, an investigative and prosecutorial body, leads this initiative.

President Donald Trump signed this memorandum, titled "Countering Domestic Terrorism and Organized Political Violence," on September 25, 2025. Citing riots in Los Angeles and Portland, the memorandum states that attacks on ICE officers increased by more than 1,000% since January 21, 2025, compared to the same period the previous year. The memorandum states, "This political violence is not a series of isolated events and does not arise organically," defining it as "the result of sophisticated and organized campaigns of targeted menace, radicalization, intimidation, and violence designed to silence dissent, restrict political activity, change or drive policy outcomes, and prevent the functioning of a democratic society."

Section 2 of the memorandum provides that nationwide Joint Terrorism Task Forces and regional offices coordinate and oversee a comprehensive national strategy to investigate, prosecute, and disrupt groups and individuals engaged in political violence and intimidation aimed at suppressing lawful political activity or impeding the rule of law. The memorandum directs the Attorney General to prosecute all related federal crimes to the fullest extent permitted by law and specifies arson offenses under 18 U.S.C. § 844 among the crimes investigative agencies should prioritize, along with assaults on federal officers, conspiracy against rights, and material support of terrorism.

Section 2(h) of the memorandum provides that the Attorney General issue specific guidance incorporating politically motivated acts of terrorism—such as organized doxing campaigns, swatting, rioting, looting, trespassing, assault, destruction of property, threats of violence, and civil unrest—into domestic terrorism response priorities. Section 4 directs the Attorney General and the Secretary of Homeland Security to designate domestic terrorism as a national priority area and establish grant programs that allocate funding to help law enforcement partner agencies detect, prevent, and defend against threats in this area.

The memorandum also cites a presidential order dated September 22, 2025, that designated Antifa as a domestic terrorist organization, stating that "the groups and organizations that propagate this extremism have created movements that embrace and encourage violence to achieve policy outcomes." It states that the United States must have "a national strategy to investigate and disrupt the networks, groups, and organizations that promote political violence," thereby enabling law enforcement agencies to intervene before criminal conspiracies lead to violent political acts.

Attempted Arson of a Federal Building Carries Minimum 5 Years, Maximum 20 Years in Prison

Under 18 U.S.C. § 844(f)(1), whoever maliciously damages or destroys, or attempts to damage or destroy, by means of fire or an explosive, any building, vehicle, or other property in whole or in part owned or possessed by, or leased to, the United States, or any department or agency thereof, shall be imprisoned for not less than 5 years and not more than 20 years, fined, or both. Subsection (f)(2) of the same statute provides for imprisonment of not less than 7 years and not more than 40 years if such conduct causes personal injury, or creates a substantial risk of injury, to any person, including any public safety officer.

Section 1361 of the same title provides penalties for anyone who willfully injures or commits any depredation against any property of the United States, or of any department or agency thereof, or attempts to do so. If the damage or attempted damage exceeds $1,000, it is punishable by a fine, imprisonment for not more than 10 years, or both; if it does not exceed $1,000, it is punishable by a fine, imprisonment for not more than one year, or both.
