川普敲定俄羅斯商品500%、俄原油進口國100%關稅率……適用立即以豁免綁定

The White House 於 2026 年 10 月 17 日上午 9 點 34 分公布了由唐納·川普總統簽署的 Executive Order 「Implementing the Lindsey O. Graham Sanctioning Russia and Iran Act of 2026」。簽署日期為 2026 年 10 月 16 日。川普總統在此項 Executive Order 中規定，對來自俄羅斯聯邦的商品關稅稅率調高 500%。對進口俄羅斯產原油與天然氣最多的 5 個國家的商品，關稅稅率調高 100%。對協助規避俄羅斯石油制裁最多的 5 個國家的商品，關稅稅率亦調高 100%。原油與天然氣條款中包含 2026 年 10 月 18 日這一日期。川普總統在同一 Executive Order Section 4 中，對這些關稅及法律制裁的適用給予了 waiver。

1. Executive Order 的構成

川普總統於 2026 年 9 月 18 日簽署了《林賽·O·葛蘭姆制裁俄羅斯與伊朗法》。載於法典第 22 編 Section 10802 及以下條款的這部法律即 the Graham Act, i.e. the Lindsey O. Graham Sanctioning Russia and Iran Act of 2026。根據 Executive Order Section 1，the Graham Act 規定了對外國人與個人的制裁及限制，以及對從俄羅斯聯邦和特定國家進入美國的商品加徵關稅。the Graham Act Section 115 賦予總統 waiver 權限。總統可對制裁條款、限制及關稅的適用給予 waiver。若要給予 waiver，必須向國會提交書面證明，證明 waiver 符合美國國家利益，並提交載明其依據的報告。川普總統在 Section 1 中規定目前啟動此項 waiver。他已向國會提交證明，證明現階段的 waiver 符合美國國家利益。

Executive Order 由 Section 1 至 Section 7 共七個條款組成。Section 2 規定調高關稅稅率。Section 3 指示 Office of the United States Trade Representative (USTR) 密切關注情況並向總統報告。Section 4 對關稅、制裁及限制的適用給予 waiver。Section 5 將法律賦予總統的權限分派給國務卿、財政部長、能源部長及 Office of the United States Trade Representative (USTR)。Section 6 規定即使部分條款無效，其餘條款亦不受影響。Section 7 是一般規定，規定 Executive Order 不得損害行政各部會與機構既有的法定權限。

2. 俄羅斯產商品調高 500% 及疊加於既有關稅的方式

Executive Order Section 2 subsection (a) 規定，對來自俄羅斯聯邦的商品關稅稅率以 ad valorem 基準調高 500%。ad valorem 是按商品價格比例課徵的方式，Executive Order Section 2 subsection (a) 中寫道 'shall be increased by 500 percent ad valorem'。此項調高適用 the Graham Act Section 114 的例外規定。Section 4 的 waiver 亦適用於此項調高。Section 4 的 waiver 是以川普總統向國會提交的國家利益證明為依據。例外規定與 waiver 均共同載於規定調高 500% 的同一條款內。

Section 2 subsection (d) 規定，調高部分疊加於既有負擔之上。此項調高追加於適用於該商品的其他關稅、規費、稅捐及附加費之上。Executive Order 列舉了四個例子。首先是依據涉及反傾銷稅與平衡稅的《1930 年關稅法》第 7 編所課徵的關稅。其次是依據《1974 年貿易法》Section 122、Section 201 及 Section 301 所課徵的關稅。依據《1962 年貿易擴展法》Section 232 所課徵的關稅亦包含在內。新關稅稅率並不取代既有關稅稅率，而是疊加於既有關稅稅率之上。Executive Order 僅規定關稅稅率。

3. 俄羅斯產原油與天然氣最大進口 5 國及 10 月 18 日日期

Executive Order Section 2 subsection (b) 鎖定進口俄羅斯產原油與天然氣最多的 5 個國家。若這 5 個國家中的任一國家在 2026 年 10 月 18 日之後新採購俄羅斯產原油或天然氣，來自該國商品的關稅稅率將以 ad valorem 基準調高 100%。調高的要件有三項：日期必須在 2026 年 10 月 18 日之後、必須為新採購，且該國必須明知（'knowingly'）採購。這並非僅憑日期就自動適用的架構，必須同時滿足這三項要件，才適用調高 100%。

The White House 於 2026 年 10 月 11 日在 X 貼文中表示，俄羅斯與烏克蘭之間的戰爭中，能源停火立即生效。

此條款亦適用 the Graham Act Section 114 的例外規定與 Section 4 的 waiver。執行該條款的機構為 Office of the United States Trade Representative (USTR)。Office of the United States Trade Representative (USTR) 將與國務卿、財政部長、能源部長以及貿易代表認為適當的其他高階官員進行諮商。各國進口與採購俄羅斯產原油及天然氣的情況由 Office of the United States Trade Representative (USTR) 進行監控。Office of the United States Trade Representative (USTR) 會定期向總統通報此類動態並建議採取進一步措施。

4. 協助規避俄羅斯石油制裁前 5 大國與 USTR 的報告

Executive Order Section 2 subsection (c) 鎖定協助規避俄羅斯石油制裁的前 5 大國。對來自這 5 個國家的商品關稅稅率以 ad valorem 基準調高 100%。協助規避制裁的定義依據 the Graham Act Section 113 subsection (i)。此條款亦適用 the Graham Act Section 114 的例外規定與 Section 4 的 waiver。此條款中並無 10 月 18 日這一日期。日期僅載於原油與天然氣條款中，而協助規避制裁條款的規定並未設定日期。

Office of the United States Trade Representative (USTR) 在此條款中亦與國務卿、財政部長、能源部長以及貿易代表認為適當的其他高階官員進行諮商。各國協助規避俄羅斯石油制裁的活動由 Office of the United States Trade Representative (USTR) 進行監控。哪些國家名列前 5 大國，由 Office of the United States Trade Representative (USTR) 向總統報告。

Section 3 為 Office of the United States Trade Representative (USTR) 規定了更廣泛的監控範圍。Office of the United States Trade Representative (USTR) 共同監控俄羅斯產原油與天然氣的進口與採購情況，以及各國協助規避俄羅斯制裁的情況。該機構定期向總統報告上述情況。若出現被認為需要採取進一步措施的情況，將毫不拖延地通報總統。該報告中包含有關 waiver 的判斷。

5. Section 4 的 waiver

Executive Order Section 4 subsection (a) 對 the Graham Act Section 112 與 Section 113 以及本 Executive Order 所規定的關稅適用給予 waiver。Executive Order Section 4 subsection (a) 中寫道 'I hereby waive the application of any duties'。川普總統已向國會提交證明該項 waiver 符合美國國家利益的證明書，以及載明其依據的報告。

Section 4 subsection (b) 對 the Graham Act Section 102 subsection (d) 中針對外國人與個人的制裁及限制給予 waiver。同項規定，2026 年 3 月 24 日延續的國家緊急狀態（即關於俄羅斯政府有害外國活動的既有 Executive Order）之制裁與措施不受本 Executive Order 影響。

Section 4 subsection (c) 對 the Graham Act Section 102 subsection (a) 及 subsection (e)、Section 103 至 Section 111 以及 Section 117 的制裁與限制給予 waiver。對於此項 waiver，川普總統亦向國會提交了國家利益證明與依據報告。

Section 4 subsection (d) 規定了 waiver 持續的期間。waiver 在總統或國務卿認定採取進一步措施為適當之前持續有效。國務卿將與財政部長及 Office of the United States Trade Representative (USTR) 諮商後做出此項判斷。Executive Order Section 4 subsection (d) 中寫道 'until such time as the President or the Secretary of State ... determine that further action is appropriate'。

程序依以下順序進行：川普總統在 Section 2 中規定了對俄羅斯產商品 500% 以及相關 5 國 100% 的關稅稅率。在同一 Executive Order Section 4 中，對該關稅及法律制裁的適用給予了 waiver。Office of the United States Trade Representative (USTR) 監控各國的採購與協助活動並向總統報告。總統或國務卿在接獲該報告後，決定採取進一步措施是否適當。

6. 後續步驟

後續步驟已在 Executive Order 中明確規定。Office of the United States Trade Representative (USTR) 與國務卿、財政部長及能源部長諮商，監控各國的採購及協助規避制裁活動。該機構定期向總統報告該情況，並向總統通報被認為需要採取進一步措施的情況。協助規避制裁的前 5 大國名單亦將向總統報告。

Section 5 將法律賦予總統的權限分派給國務卿、財政部長、能源部長及 Office of the United States Trade Representative (USTR)。各機關首長得在法律允許的範圍內，在其機關內部進一步轉授該權限。所有行政部會與機構均須在其權限範圍內採取措施以執行本 Executive Order。

在總統維持 waiver 期間，Section 2 的關稅稅率調高維持被給予 waiver 的狀態。Office of the United States Trade Representative (USTR) 的各國報告，以及總統或國務卿對 waiver 的判斷，將是後續步驟。
